A 37 year old Llandudno man is back in jail  after being given an extra 18 months in a landmark ruling.

Peter Jason Roberts was handed over by police to security staff to be taken back to prison.

 The Lord Chief Justice, Lord Judge, announced in a series of highly significant “one-punch” judgments in the Court of Appeal that both Thomas Bryan, 46, of Rhuddlan, Rhyl, and Roberts will each have to serve an extra 18 months for the manslaughter of Jonathan Bennett.

      Mr Bennett, 40, died after suffering brain damage in an incident outside the Grapevine public house at Rhyl in January.

        In July, Bryan,  who delivered the single punch which floored Mr Bennett, was jailed for three and a half years after admitting the offence. Roberts got 18 months after being found guilty.

        Mr Bennett’s mother Angela Witherspoon, of Coast Road, Rhyl, says she is relieved and delighted by the decision. Roberts had been released in November but was ordered by the court to turn himself in.

      Mrs Witherspoon had written to Attorney General Baroness Scotland urging an appeal against the sentences and soon learned that the matter would be considered.

            “I promised myself I would do everything possible for Jon’s sake but I had no idea that there would be such a positive outcome,” she said.

           Mrs Witherspoon said she was also pleased that the sentencing guidelines for such cases were being revised as a result of her son’s case. It is understood that sentence has been deferred in three cases in North Wales pending the outcome of the Appeal Court hearing.  It would make people think before getting involved like these two did, she declared.
